First things first: Yay for the Music Mill show! To answer your question the best I can--I'm sure Claude or one of out other tapers will have a far better answer than me, but here's what the taping policy stated on the old website. From here.
"One of the things I've always loved about shows and music is taping. I used to be really into the Grateful Dead and collected tons of tapes. Later it was bands like Pearl Jam, Dave Matthews and most recently Ryan Adams. As a fan of music, I love that stuff and love the idea of our fans being able to pass around our adventures on the road. I would encourage you to tape the SK6ERS shows for personal, non-commercial use and trading. I'm especially into the idea because for the time being we're not able to offer high quality recordings of all our shows to you (although we're working on that for the future). Due to our commitments to our recording company, and because I don't really like Soundboard tapes unless they are really well mixed, we aren't able to allow soundboard patches or video recording (which can look really ghetto anyway, and sometimes takes away from what the night was). If you do bring in your video camera and we let it go, don't turn around and do something stupid like sell it on the Internet... but I like to think that our fans are the kind of people who wouldn't do that. So yeah, it's ok with us if you tape...oh yeah... two other things; make sure that your taping gear isn't in the way of anyone's view or experience at the show and please do send us a copy to: Fat Sam Music, 261 Crescent Street #1, Northampton, MA 01060. "
I assume that this is still the case. Hope that helps!
